Bad news for Sen. Pete Domenici. His attempt to emulate Larry Craig's legal defense funding strategy apparently has unraveled.

(See earlier post).

Domenici has withdrawn his request to use campaign funds to pay his legal bills, despite an FEC advisory opinion of two weeks ago that gave him the go-ahead to do so.

From Congressional Quarterly:
The Federal Election Commission's attempt to pursue business as usual was cut short again Thursday after questions were raised about its authority to act on issues without at least a four-member quorum present... Domenici's lawyers said the lack of a quorum makes it clear that the FEC "will be unable to rule on our request" definitively.

The FEC recently lost three commissioners who had served in 2007 after their presidential recess appointments expired... The current deadlock centers on President Bush's renomination of Hans von Spakovsky, a former assistant attorney general for civil rights.


The objections to Von Spakovsky have focused on him using his role as the Justice Department's "voting rights" chief to suppress voting rights.

New Mexico's own Heath Haussamen reports Domenici's legal problems are far from over.
